General terms and conditions
Our general terms and conditions have also been filed with the Chamber of Commerce in Groningen under number 94273871.
Article 1. Applicability
1.1 These General Terms and Conditions of Sale apply to all offers, orders, and agreements of Annie Green. These Terms have been filed with the Chamber of Commerce and will be sent upon request. They are also available online at www.anniegreen.nl.
1.2 Accepting an offer or placing an order implies acceptance of these Terms.
1.3 Deviations from these Terms are only valid if agreed in writing, in which case the remaining provisions remain fully applicable.
1.4 All rights and claims as stated in these Terms and in any further agreements for the benefit of Aaltjes Online also apply to intermediaries and other third parties engaged by Aaltjes Online.
Article 2. Offers and agreements
2.1 All offers are without obligation and Aaltjes Online expressly reserves the right to change prices, particularly when required by legal regulations. See also Article 3.6.
2.2 An agreement is only concluded after acceptance of your order by Aaltjes Online. Aaltjes Online is entitled to refuse orders or attach conditions to delivery, unless explicitly stated otherwise. If an order is not accepted, this will be communicated within ten working days after receipt.
2.3 Biological control products are living organisms and cannot be returned. By ordering these products, you confirm that you will accept them.
Article 3. Prices and payments
3.1 All prices listed on the website are in euros and exclude handling and shipping costs, taxes, or other charges, unless stated otherwise.
3.2 Payment must be made without discount or compensation before delivery, unless agreed otherwise in writing.
3.3 Payment can be made using the methods indicated during the ordering process. Additional conditions may apply. For bank transfers, the payment date is the date the amount is credited to the bank account of Aaltjes Online.
3.4 In case of late payment, a delay interest of 1 percent per month will be charged from the due date until the date of payment. If payment is made after a reminder, an administrative fee of €19.50 will be charged. If the claim is handed over for collection, collection costs of at least 15 percent of the outstanding amount will apply, without prejudice to the right to claim actual costs.
3.5 If you fail to meet any payment obligation, Aaltjes Online is entitled to suspend or terminate the agreement.
3.6 If prices increase between order and delivery, you have the right to cancel within 10 days after notification, provided the products have not yet been delivered.

Article 4. Delivery
4.1 Aaltjes Online reserves the right to adjust delivery times due to weather conditions. Any resulting damage cannot be claimed.
4.2 Delivery times are indicative only. Exceeding a delivery time does not entitle you to compensation or cancellation, unless the delay is unreasonable.
4.3 Delivery takes place at the time and place where the products are ready for shipment.
Article 5. Retention of title
5.1 Ownership of products transfers only after full payment of all amounts due. Risk transfers at the moment of delivery.
Article 6. Intellectual and industrial property rights
6.1 You must fully respect all intellectual and industrial property rights related to the products.
6.2 Aaltjes Online does not guarantee that the products do not infringe on third-party rights.
Article 7. Complaints and liability
7.1 You must inspect products upon delivery or as soon as possible thereafter and verify:
- whether the correct items were delivered
- whether the quantity matches the agreement
- whether the quality meets expectations
7.2 Visible defects must be reported before 12:00 the next day and confirmed within 48 hours after receipt.
7.3 Hidden defects must be reported within 8 days after discovery, and no later than 1 month after delivery.
7.4 Complaints regarding invoices must be submitted within 8 days after receipt.
7.5 Failure to meet these deadlines results in loss of rights.
7.6 Even in case of complaints, you remain obliged to accept and pay for the goods. Returns require prior written approval.
7.7 If products are proven defective, Aaltjes Online may replace them or refund the invoice value.
7.8 All products are delivered in good condition. Consumers have a 14-day withdrawal period from receipt. Return shipping costs are at your expense. Products must be unused and in original condition. Biological control products are excluded from returns. The right of withdrawal applies only to consumers, not business customers.
7.9 Aaltjes Online accepts no liability for the use of its products. Use is entirely at your own risk. Any direct or indirect damage is explicitly rejected.
Article 8. Orders and communication
8.1 Aaltjes Online is not liable for errors, delays, or failures in communication caused by internet or other communication methods, unless there is intent or gross negligence.
Article 9. Force majeure
9.1 In case of force majeure, Aaltjes Online may suspend or terminate the agreement without compensation.
9.2 Force majeure includes any circumstance beyond the control of Aaltjes Online.
Article 10. Miscellaneous
10.1 Orders will be shipped to the address provided unless otherwise specified.
10.2 Tolerance of deviations does not waive the right to enforce these Terms.
10.3 Invalid provisions will be replaced by valid equivalents.
10.4 Aaltjes Online may use third parties to execute orders.
Article 11. Governing law and jurisdiction
11.1 Dutch law applies to all agreements and these Terms.
11.2 All disputes will be submitted exclusively to the competent court in the Netherlands.
